Terms of Sale

1. Preamble

These Terms of Sale (hereinafter “TOS”) govern the contractual relations between Psychonauts 808 (hereinafter “PSYCHONAUTS 808”, “the Seller” or “we”) and any person making a purchase on the site accessible via the main domain of PSYCHONAUTS 808 (hereinafter “the Client” or “you”).

Every order implies full and complete acceptance of these TOS. The Client acknowledges having read them before validating their order. The applicable TOS are those in force at the time of the order.

2. Products offered

PSYCHONAUTS 808 sells digital goods :

• Beats (instrumentals) under MP3, WAV or Exclusive license ;
• Drumkits (audio sample packs) ;
• Monthly subscriptions (Membership) entitling to 2 beats per month.

The essential characteristics of each product (title, BPM, key, duration, price, license type) are indicated on the corresponding product page. Visuals and audio excerpts are provided for information purposes and have no contractual value.

3. Prices

Prices are indicated in euros (€) or US dollars ($) depending on the product, taxes included where applicable. PSYCHONAUTS 808 reserves the right to modify its prices at any time, it being understood that the price appearing on the page on the day of the order is the only applicable one.

4. Order

The order process takes place in several stages : adding to cart, choice of license, validation of summary and payment. The order is only final after receipt of payment.

PSYCHONAUTS 808 reserves the right to refuse or cancel any order for legitimate reasons, in particular in case of suspected fraud, payment incident, or abusive behavior of the Client.

5. Payment

Payment is made by manual PayPal transfer to the merchant address Psychonauts808@gmail.com, mandatorily including the order number in the PayPal message. After manual verification of the payment by PSYCHONAUTS 808 (typically within a few hours), the Client receives their download links by email. No banking data is retained by PSYCHONAUTS 808 : the transaction is processed exclusively by PayPal under their own terms available at paypal.com.

6. Delivery of files

Files are delivered in digital form, by email to the address entered at checkout, within a maximum period of 24 working hours from confirmation of payment (typically within minutes). Any delay must be reported by email to contact@psychonauts808.com.

The Client is solely responsible for providing a valid email address and checking their spam folder.

7. Right of withdrawal

In accordance with article L221-28 13° of the French Consumer Code, the right of withdrawal cannot be exercised for the supply of digital content not provided on a physical medium, the performance of which has begun after the consumer's prior express agreement and express waiver of their right of withdrawal.

By validating their order, the Client expressly acknowledges requesting immediate execution of the contract (download) and accepts that their right of withdrawal ends as soon as the digital file is made available. No refund may be claimed after download, except in exceptional cases assessed by PSYCHONAUTS 808.

8. Licenses and intellectual property

Beats and drumkits remain the exclusive intellectual property of PSYCHONAUTS 808. The Client acquires no ownership right over the work : they acquire only the rights of use defined by the purchased license (MP3, WAV, Exclusive). Any use beyond the rights granted by the license constitutes counterfeiting, punishable under articles L335-2 and following of the French Intellectual Property Code (up to 3 years of imprisonment and a €300,000 fine).

9. Membership subscription

The Membership subscription (€20/month) entitles to 2 beats of choice per month from the catalogue, under MP3 + WAV license. The Client must report their 2 chosen beats by email to contact@psychonauts808.com within the current month ; unused months are not carried over.

The subscription can be cancelled at any time from the Client's PayPal account (by stopping the recurring payment). Cancellation takes effect at the end of the current paid period. No prorata refund is made.

10. Warranties

PSYCHONAUTS 808 makes its best efforts to provide technically usable files. The Client is nevertheless solely responsible for the compatibility of the files with their hardware and software. The Client is invited to listen to the excerpt before any purchase.

11. Liability

The liability of PSYCHONAUTS 808 cannot be engaged for indirect damages (loss of opportunity, loss of profit, etc.). It is in any case limited to the amount of the order concerned.

12. Personal data

Data collected as part of an order are processed in accordance with our Privacy Policy.

13. Applicable law and disputes

These TOS are subject to French law. In case of dispute, the Client may attempt an amicable resolution by contacting us at contact@psychonauts808.com. Failing agreement, the Client may use the services of a consumer mediator free of charge in accordance with article L612-1 of the French Consumer Code.

Failing an amicable settlement, the French courts will have jurisdiction. For consumer Clients, article R631-3 of the French Consumer Code applies.

14. Modification of TOS

PSYCHONAUTS 808 reserves the right to modify these TOS at any time. The TOS applicable to an order are those in force on the date of validation of that order.
